Personal Injury Law
My firm handles all types of significant personal injury and wrongful death cases, including automobile wrecks, premises liability accidents, job-related accidents, construction accidents, aviation and watercraft accidents, slip-and-falls, dog attacks, motorcycle accidents, semi-truck accidents and litigation. Personal injuries not only cause physical pain, but often emotional and financial hardship through loss of work, medical bills and stress placed upon families and loved ones. Recoverable damages include past and future medical expenses, physical pain and suffering, mental anguish, physical impairment, disfigurement, lost wages, and loss of earning capacity.

All estate plans should include, at minimum, two important estate planning instruments: a durable Power of Attorney and a Will. The first is for managing your property during you life, in case you are ever unable to do so yourself. The second is for the management and distribution of your property after death. In addition to these planning instruments, more and more Americans today are using revocable (or living) trusts to avoid probate and to manage their estates both during their lives and after theyre gone. A complete estate plan should also include a medical directive that may encompass a number of different documents, including a durable Health Care Power of Attorney, a Living Will, and medical instructions. My firm handles a variety of estate planning matters and advises clients so as to gain the maximum benefit of all laws, while, at the same time, carrying out the persons wishes.

Probate and Trust Administration
Logically following estate planning is probate and trust administrationputting the plan into operation. My firm represents fiduciaries and beneficiaries in all North Carolina probate courts by filing the necessary pleadings to admit a decedents Will to probate, preparing all documents and filings required under North Carolina laws and procedures, and assisting their tax professionals in the preparation of income tax returns for the estate, as well as any required estate tax returns. Trust administration does not usually require court pleadings or filings, but many of the same administration, distribution or tax issues are present and require attention. In this area, my firm counsels fiduciaries regarding the rights and interests of beneficiaries, and recommends steps or actions to help the fiduciary operate the trust in compliance with the appropriate fiduciary laws and avoid personal liability for their actions, or inaction. My firm takes special care during these difficult times to represent families with caring and compassionate counsel, guidance and direction. My firm is well aware of the stress that legal proceedings often times add to a difficult situation, and I strive to complete the formal process as quickly as possible while maintaining an eye towards your expressed goals. The form of entity selected for the conduct of a business greatly impacts the daily operations of the business and the income tax consequences to both the business and its owners. My firm assists clients and their tax professionals with this step of business formation by reviewing the goals and individual facts present in each situation to recommend the best entityselecting from limited/general partnerships, limited liability companies, or corporations, and the different elections or options available under each. The services involved here extend from the initial conference and decision making, through document preparation and filing with appropriate authorities, to post-formation activities such as preparation and adoption of bylaws, director/shareholder resolutions and agreements, and manage necessary meetings as well as the documentation thereof.

Debtor/Creditor Litigation
My firm advises clients in consumer actions, such as collection actions, consumer leases, and breach of contract actions. I advise both debtors and creditors of their rights and any relief available to them. I litigate collection actions through judgment, execution, and post-execution levels.
