Established in 1979 in the General Practice of Law with concentration in Family Law, Bankruptcy, Social Security, and Traffic Law. Family law includes divorce, separation agreements, custody, visitation, support, adoption, name change, equitable distribution and divorce from bed an board.
Generally in order to file for a divorce in North Carolina, you must be separated for one year, you must be a resident of North Carolina for six months prior to filing your petition and you must have the intent of making North Carolina your permanent home. If there are adequate grounds and you have not been separated for one year, you may file for a court-ordered separation which is called a divorce from bed and board. Equitable Distribution is the separation and distribution of all marital assets.
Bankruptcy - This office handles Chapter 7 and Chapter 13 bankruptcy proceedings. Chapter 7 will liquidate your unsecured creditors while you maintain possession of current accounts of automobile and home. Chapter 13 will consolidate your accounts into a repayment plan over three to five years. Chapter 13 also allows you to bring past due home and car accounts to a current status to stop repossessions and foreclosures.
Social Security- This office provides representation for Social Security Disability applications including reconsideration and hearing levels.
Traffic- This office handles all types of traffic matters.
These fees may vary depending on complexity of your case and increases in court fees, fines or other costs.
Adoption - $550.00 plus service and filing fee
Annulment - $430.00 plus cost of service on opposing party
Chapter 7 - $1000.00 plus, depending on complexity of case and number of creditors
Chapter 13 - $500.00 to begin process with the remainder of the fee to be paid through the Chapter 13 Plan with the Court. Total fee will vary depending on the complexity of the case and the number of creditors.
Uncontested Divorce - $360.00 total with service on the opposing party by personal acceptance or certified mail. IF requesting the return to the maiden name add an additional $10.00 = $370.00
Power of Attorney - $150.00
Separation Agreement - $750.00 (May increase depending on complexity.)
Simple Will - $250.00
